Interim Measures for the Management of the list of high-end Talents in short supply




Article 1 In accordance with the provisions of the Hainan Free Trade Port Law of the People's Republic of China, the General Plan for the Construction of Hainan Free Trade Port and the Notice of the General Administration of Taxation of the Ministry of Finance on the Individual Income Tax Policy of Hainan Free Trade Port for High-end Talents in Short Supply (Finance and Taxation No. 2020), These Measures are formulated to implement the preferential individual income tax policies for high-end talents and talents in short supply in Hainan Free Trade Port.




Article 2 List management shall be implemented for high-end talents and talents in short supply who work in Hainan Free Trade Port and enjoy preferential policies.




Article 3 To enjoy preferential policies, the following conditions shall be met:




(1) Have resided in Hainan Free Trade Port for 183 days in a tax year.




(2) Talents recognized by talent management departments at all levels of Hainan Province or earning more than 300,000 yuan in Hainan Free Trade Port in a tax year (Hainan Province implements dynamic adjustment according to economic and social development).




Article 4 Due to their professional characteristics, the personnel in aviation, shipping, offshore oil and gas exploration and other industries who have resided in Hainan Free Trade Port for less than 183 days in a tax year shall, while meeting the requirements of Paragraph 2 of Article 3 of these Measures, In a tax year, pay basic old-age insurance (except for exempt workers in countries that have signed social security agreement with China) for more than 6 months continuously in Hainan Free Trade Port as a unit employee (including the December of the current year). Article 7 Those identified as high-end talents and talents in short supply shall enjoy preferential policies of individual income tax in the current year. Those who no longer meet the requirements of high-end talents and talents in short supply shall not enjoy preferential policies of individual income tax in the current year.




Article 8 Persons who are subject to joint punishment for trust-breaking according to law shall not enjoy preferential policies of individual income tax.




Article 9 Relying on the social management information Platform of Hainan Province, the departments of human resources and social security, public security, market supervision and taxation of Hainan Province shall strengthen in-process and post-event supervision, carry out random inspection on the situation of enjoying the preferential policies of individual income tax, and carry out risk assessment and risk response according to the inspection results.




Article 10 In case of any objection or dispute to the talents enjoying the preferential policies of individual income tax, the human resources and social security departments at all levels of Hainan Province shall take the lead and coordinate to solve the problem. If there is any objection or dispute on whether the enterprises or units of talents have substantive operation in Hainan Free Trade Port, the market supervision and administration department of Hainan Province shall take the lead and coordinate to solve the problem.




Article 11 The departments of human resources and social security, public security, finance, market supervision and taxation of Hainan Province may formulate specific implementation provisions in combination with these Measures.




Article 12 These Measures shall come into force as of January 1, 2023. The Interim Measures for the Management of the List of High-end Talents in Short Supply Enjoying the Preferential Individual Income Tax Policy of Hainan Free Trade Port (Qiongfu [2020] 41) issued by Hainan Provincial People's Government on August 26, 2020 shall be repealed at the same time.
